What is a club licence?

The cannabis club licence (or, more precisely, registration as a non-profit association according to Organic Law 1/2002) is a legal permit required for cannabis clubs to operate in a regulated and legally compliant manner. In other words, it is essential to ensure that the club’s activities are carried out within the legal frameworks established in Spain.

What the licence allows and what it restricts

Once obtained, it grants the entity the right to operate legally under strict regulations, which ensure that cannabis cultivation and consumption takes place in private, non-profit spaces. Club members must be individually registered and access must be restricted to verified members. The licence also limits the amount of cannabis that can be distributed to members.

On the other hand, the licence does not allow the sale of cannabis to non-members or the promotion of these clubs in public. Consumption must take place in private spaces and cannot be shared or sold to non-members.

Types of licences and permits required

There is no single specific licence for cannabis clubs at the national level, but regulation is based on the Law on Associations and municipal regulations. In order to operate legally, it is necessary to obtain several permits and licences, each with a different purpose for the club’s activity.

Municipal licences

The first step is usually to obtain a municipal opening licence, which authorises the use of the premises for the activity of a social or recreational club. This requires the submission of a declaration of responsibility to the local council of the municipality concerned and, in some cases, compliance with certain requirements regarding location, ventilation, distance from schools or hospitals, and the absence of outdoor advertising. Each locality has its own regulations and may have additional requirements, such as the presentation of a guarantee, identification documents of the founders, articles of association, by-laws and guarantees that only adults will be allowed access.

Health and safety permits

These permits ensure the protection of public health and the adequate habitability of the spaces. For example, air quality, adequate ventilation, sufficient lighting and the absence of health hazards for members must be ensured. In addition, the municipality may require the presentation of certificates related to the habitability and safety of the premises, as well as soundproofing to avoid nuisance to the neighbourhood.

The club must be formally constituted and registered as a non-profit association, in accordance with Organic Law 1/2002 regulating the Right of Association, which implies that all profits generated by the club’s activity must be used exclusively for the maintenance of the club’s activities and cannot be distributed among the members.

In order to do so, it is necessary to comply with the legal requirements for setting up an association, such as drafting statutes, electing a board of directors and submitting the corresponding documentation to the National Register of Associations or the corresponding regional register.

Other permits

In the case of large clubs, further permissions, such as those related to member data protection or occupational safety measures, have to be managed. Cannabis associations must apply the Organic Law on Data Protection (LOPD) and, in case any of the members consume cannabis for therapeutic reasons, they must apply the high level of security in data processing.

Licensing requirements

Obtaining a cannabis club licence is not a simple process: there are a series of legal requirements that must be met, both in terms of the location and the characteristics of the premises, the members and the documentation to be submitted.

Requirements for the premises

The premises must meet certain conditions in order to be approved as a cannabis club space. First, the location will be analysed, which must be suitable and away from residential areas (depending on the city) or high traffic areas, such as schools or public care centres. The size of the premises is also a key factor, as it must be large enough to accommodate members, but within the limits set by law.

Similarly, the premises must have restricted access to ensure the privacy of members and prevent access by outsiders. Security standards also require the installation of surveillance and access control systems, such as security cameras, to ensure the protection of both the premises and the members.

Minimum and maximum number of members

In order to obtain a cannabis club licence, the legislation also establishes a minimum number of members, which is 3. As for the maximum, it varies depending on the autonomous community, which in some cases is 200 members, although there are exceptions depending on the type of club and its location.

Documentation required for the application

When applying for the licence, certain documents must be submitted, such as the registration of the association, proof of ownership or lease of the premises, the club’s activity plan and the identification documents of the members. It is also common to require a report justifying the planned activities and the objectives of the club.

Conditions for operation

The operation of the club should be governed by a set of internal rules to ensure a safe and controlled environment. These include rules on access control to the premises, prohibition of off-premises consumption, and adherence to established opening and closing times.

Licence application procedure

The procedure for applying for a cannabis club licence is quite detailed and must be carried out in an orderly manner to comply with all legal regulations.

Administrative steps to follow

The first step is to submit a formal application to the relevant local council or autonomous community, depending on the location of the club. This application must include all the required documentation, such as the association’s registration, proof of ownership of the premises and plans of the premises where the activities will take place.

Once the application has been submitted, all legal and administrative requirements will be checked for compliance and an inspection of the premises may be carried out by the competent bodies.

Estimated deadlines

The time required to obtain a cannabis club licence varies, but can generally take between 3 and 6 months from the submission of the application, depending on the autonomous community and the administrative burden of the local authority. During this period, authorities may request additional information or amendments to the initial application.

Costs and fees

The licensing process involves certain administrative costs and fees that must be paid at the time of application, such as the processing fee, which usually exceeds €1000 in many cities. Costs for health and safety inspections must also be taken into account.
