With the backing of <strong>Parliament and the Senate<\/strong>, a comprehensive<strong> reform of the Criminal Code<\/strong> has been approved, <strong>allowing the cultivation and possession of marijuana for personal use<\/strong>, while introducing measures aimed at relieving pressure on the judicial and prison systems. The new law, still awaiting presidential signature, could come into force on January 1, 2026, and mark a radical change in terms of <strong>censorship in the search for marijuana and cannabis<\/strong>.  <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-cambios-clave-en-la-legislacion-sobre-cannabis\"><strong>Key changes in cannabis legislation<\/strong><\/h2>\n\n<p>The legislative branch has given the green light to the following: <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-autocultivo-de-cannabis-y-posesion-despenalizados\"><strong>Decriminalization of cannabis cultivation and possession<\/strong><\/h3>\n\n<p>The reform establishes that adults over the age of 21 may grow <strong>up to three marijuana plants<\/strong> in their homes and possess <strong>up to 100 grams of dried cannabis<\/strong> on private property, or <strong>25 grams in public spaces<\/strong>. These amounts are considered within the legal framework for personal use. <\/p>\n\n<p>However, exceeding these limits will continue to have criminal consequences: between four and five plants will be considered a <strong>minor offense<\/strong>, while higher numbers, as well as possession of <strong>more than 200 grams at home<\/strong>, will be classified as <strong>serious crimes<\/strong>.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-uso-terapeutico-y-marco-penal-diferenciado\"><strong>Therapeutic use and differentiated criminal framework<\/strong><\/h3>\n\n<p>The legal text also provides for the<strong> legalization of the therapeutic use of psilocybin<\/strong>, the active ingredient in hallucinogenic mushrooms, which equates it with medical cannabis. It also introduces <strong>a new specific section in the Penal Code<\/strong> dedicated to cannabis-related crimes, which recognizes its lower social danger and proposes more proportionate penalties. With this new framework, a new debate is also expected regarding <strong>censorship in the search for marijuana and cannabis<\/strong>.  <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-modernizacion-del-sistema-penal-checo\"><strong>Modernization of the Czech penal system<\/strong><\/h2>\n\n<p>Czech legislation also seeks to make the justice system more efficient and adapted to modern times:<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-medidas-alternativas-y-racionalizacion-judicial\"><strong>Alternative measures and judicial streamlining<\/strong><\/h3>\n\n<p>Beyond cannabis, the reform seeks to <strong>rationalize <\/strong>the state&#8217;s criminal justice response.<strong> Alternative penalties, such as fines or probation, are being expanded<\/strong>, especially for minor offenses, including failure to pay child support. The goal is to<strong> reduce recidivism and the number of people incarcerated<\/strong>.  <\/p>\n\n<p>Some critics have pointed out that the widespread use of economic sanctions could lead to inequalities and even allow people with greater resources to avoid prison. However, <strong>the government has defended the measure as a way of adapting justice to the social and economic reality of the country<\/strong>. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-impacto-nacional-y-relevancia-europea\"><strong>National impact and European relevance<\/strong><\/h2>\n\n<p>With this reform, the Czech Republic has become the <strong>second major European nation (after Germany) to allow the cultivation of cannabis for recreational purposes<\/strong>. The measure has been welcomed by pro-legalization groups, such as the Association for Rational Regulation (RARE), although they have expressed reservations about the maximum possession limits, arguing that they could unfairly criminalize domestic growers who exceed the permitted amounts. <\/p>\n\n<p>In this context, it remains to be seen whether the new legislation will be accompanied in the future by the elimination of any <strong>restrictions on the search for marijuana and cannabis<\/strong>.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-un-precedente-en-el-contexto-europeo\"><strong>A precedent in the European context<\/strong><\/h3>\n\n<p>The initiative is part of a continental trend toward more tolerant models. <strong>Slovenia<\/strong>, for example, has introduced a bill to legalize cannabis for medical and scientific purposes. <strong>Germany<\/strong>, for its part, implemented the<strong> Can-G law <\/strong>in 2024, although its continuation is being reviewed by the new governing coalition. All these movements reflect a <strong>growing political will in Europe<\/strong> to treat cannabis use from a <strong>public health perspective<\/strong> rather than through criminal punishment. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-proximos-pasos-y-entrada-en-vigor\"><strong>Next steps and entry into force<\/strong><\/h2>\n\n<p>The legislation was promoted by the Czech government and supported by a large parliamentary majority. It <strong>is currently awaiting ratification by President Petr Pavel<\/strong>, who has already expressed his intention to sign it. If no further obstacles arise, the law will come into force on <strong>January 1, 2026<\/strong>.  <\/p>\n\n<p>The purpose of this legislative change goes beyond seeking to alleviate pressure on the prison system: it also seeks to <strong>bring national policies into line with a more modern and pragmatic<\/strong> approach to the use of cannabis and other psychotropic substances.
